Terms and Conditions
Effective date August 23, 2026. Please read these terms carefully before using the Nearsend peer-to-peer file transfer service in any capacity.
1. Acceptance of terms
By accessing, browsing, or using Nearsend at nearsend.app, you agree to be bound by these Terms and Conditions and the Privacy Policy in full. If you do not agree with any part of these terms, you must discontinue use of the service immediately.
2. Description of the service
Nearsend provides a web-based, browser-to-browser peer-to-peer file, text, and clipboard transfer utility powered by WebRTC technology. Nearsend does not host, store, monitor, or manage user-transmitted files.
3. Acceptable use and prohibited conduct
Nearsend must be used strictly for lawful purposes. Users agree not to use it to: transmit material that infringes intellectual property, copyrights, trademarks, or trade secrets of any third party; disseminate malicious software, viruses, trojans, ransomware, or spyware; transmit unlawful, abusive, harassing, defamatory, or threatening material; or attempt to disrupt or degrade the signaling infrastructure or interfere with other users' network connections.
4. Disclaimer of warranties
Nearsend is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. There is no guarantee of uninterrupted availability, error-free operation, or that a given local network's firewall or NAT will allow direct peer connectivity in every environment.
5. Limitation of liability
To the maximum extent permitted by applicable law, Nearsend and its operators are not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the service, data loss during peer streaming, or unauthorized access by third parties to a user's local network.
6. Governing law & modifications
These Terms may be revised or replaced at any time. Continued use of Nearsend following any update constitutes acceptance of the modified Terms.
7. Third-party infrastructure
The service relies on signaling and, when necessary, relay infrastructure to establish and assist peer-to-peer connections. This infrastructure is described in more technical detail on the "how it works" page and is subject to the same operational disclaimers set out in Section 4 above.
8. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

10. No warranty of fitness for a particular purpose
Nearsend is a general-purpose file transfer tool and makes no representation that it is suitable for any specific regulatory, compliance, or industry-specific requirement. Anyone with such a requirement should independently evaluate whether the service meets it before relying on it for that purpose.
11. Age requirement
The service is intended for use by individuals capable of forming a binding agreement under applicable law. By using Nearsend, a user represents that they meet this requirement.
12. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between a user and Nearsend regarding use of the service, superseding any prior understanding on the same subject.
13. No waiver
A failure to enforce any provision of these Terms at any point does not constitute a waiver of the right to enforce that same provision, or any other provision, at any later time whatsoever.
